This document establishes the legal conditions governing the use of our platform and the purchase of coffee on the More Coffee Please Shop platform. By browsing the site or making a purchase, you accept these terms in their entirety. If you do not agree, you must refrain from using the platform.

1. Parties and Purpose of the Contract

This contract is entered into by and between the operating company of the More Coffee Please Shop platform (hereinafter, “The Seller”) and any natural person or legal entity that accesses, browses, or makes purchases on the website (hereinafter, “The Client”). The purpose is the commercialization and national and international shipping of coffee in all its varieties and origins, as well as related items.

2. Legal Framework by Jurisdiction

The platform operates under a multinational compliance model adapted to the local laws of each destination market:

  • Mexico: In accordance with the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor – LFPC) and the Commercial Code.
  • United States: Regulated by the Federal Trade Commission (FTC) and state e-commerce laws.
  • Canada: Governed under the Consumer Protection Act of the respective provinces and applicable privacy laws.

3. Purchase Conditions and Pricing

  • Prices and Currencies: Prices will be displayed in Mexican Pesos (MXN), United States Dollars (USD), or Canadian Dollars (CAD) based on the detected location. The Seller reserves the right to modify prices without prior notice.
  • Taxes: Prices in Mexico include the corresponding VAT (IVA). For the U.S. and Canada, sales taxes (Sales Tax / GST / HST) will be calculated and added at the checkout screen.
  • Availability: Coffee is an agricultural product subject to harvest and seasonal availability. If a product becomes out of stock after a purchase is made, the Client will be notified to offer a replacement or an immediate refund.

4. Shipping, Customs, and Importation

  • Logistics: Shipments are dispatched from Mexico through authorized international courier companies.
  • Phytosanitary Regulations: Exported coffee complies with the regulations of the FDA (Food and Drug Administration) in the U.S. and the Canadian Food Inspection Agency (CFIA) in Canada.
  • Import Duties and Taxes (Duty/Tariffs): As the coffee is of Mexican origin, it benefits from tariff preferences under the USMCA (T-MEC/CUSMA). However, the Client is the importer of record and is responsible for paying any customs processing fees or local duties if their package is held or inspected by border authorities (U.S. Customs and Border Protection or Canada Border Services Agency).

5. Use of Technological Tools and Security

  • Payment Gateways: The platform utilizes encrypted third-party technological tools with SSL/TLS protocols to process payments (e.g., Stripe, PayPal). The Seller does not store clients’ credit or debit card data.
  • User Accounts: The Client is responsible for maintaining the confidentiality of their access credentials. Any activity carried out from their account shall be deemed authorized by the Client.
  • Intellectual Property: All software, code, logos, images, texts, and trademarks associated with More Coffee Please Shop displayed on the platform are the exclusive property of the Seller and are protected by international intellectual property laws.

6. Cancellation, Return, and Refund Policies

  • Nature of the Product: Being a perishable food product, no returns of coffee are accepted due to hygiene and public health reasons.
  • Defective or Incorrect Product: If the coffee arrives damaged, with its original packaging broken, or does not match the order, the Client has 2 calendar days upon receiving the package to report it, attaching photographic evidence to the support email. The Seller will assume the replacement costs.
  • Cancellations: The Client may cancel their order free of charge as long as it has not departed from the origin warehouse (status “In Process”). No cancellation is possible if the product has already been sent to or received by the Client.

7. Privacy and Data Protection

Personal data collected through the platform’s technological tools are processed in accordance with our Privacy Notice. We comply with the Federal Law on Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares) (Mexico), the California Consumer Privacy Act (CCPA) (U.S.), and the Personal Information Protection and Electronic Documents Act (PIPEDA) (Canada).

8. Jurisdiction and Dispute Resolution

For any controversy arising from the interpretation or enforcement of this contract, the parties submit to the applicable legislation (p. 3):

  • For transactions in Mexico: Courts of Mexico City (p. 3).
  • For transactions in the U.S. and Canada: Direct commercial mediation will be sought first. In the event of litigation, international trade laws and arbitration clauses stipulated in current trade agreements (USMCA) shall apply.

9. Specialty Certifications and Organic Coffee

  • Authenticity of Origin: The Seller guarantees that 100% of the commercialized coffee originates from the declared location(s), respecting the denomination or regional standards indicated on the packaging.
  • Specialty Coffee: Batches labeled as “Specialty Coffee” possess a physical and sensory evaluation that meets the score standards of the Specialty Coffee Association (SCA). Tasting notes and roast profiles described on the platform are referential to the harvested lot.
  • Organic Certification: Coffee labeled as “Organic” holds the corresponding certifications for cultivation free of agrochemicals (such as the SAGARPA/SENASICA certification in Mexico). For U.S. and Canadian markets, the product aligns with the organic equivalence agreements currently in force with USDA Organic and the Canada Organic Regime (COR).

10. Estimated Delivery Times and Shipments

Shipments are processed from our warehouses in Mexico within 24 to 48 business hours following payment confirmation. Estimated transit times are as follows:

  • Mexico: 2 to 5 business days (standard shipping) or 1 to 2 business days (express shipping).
  • United States: 5 to 9 business days (subject to clearance times at U.S. customs).
  • Canada: 7 to 12 business days (subject to Canadian customs inspection).

Note on delays: The Seller is not responsible for delays directly attributable to courier companies, extreme weather events, or holdings caused by random inspections by border authorities (CBP or CBSA).

11. Phytosanitary Regulations and Importation

  • Food Regulations: Exported coffee complies with the registrations and prior notices required by the Food and Drug Administration (FDA) in the U.S. and the Canadian Food Inspection Agency (CFIA) in Canada.
  • Import Duties and Taxes: As the coffee is of Mexican origin, it benefits from tariff preferences under the USMCA (T-MEC/CUSMA). However, the Client is the importer of record and is responsible for paying any customs processing fees or local duties if their package is held or inspected by border authorities.

The Seller will assume the replacement costs.
  • Cancellations: The Client may cancel their order free of charge as long as it has not departed from the origin warehouse (status “In Process”). No cancellation is allowed after the product has been sent to the Client.

16. Specific Policies for Wholesale Distributors and B2B

Coffee purchases in commercial volumes (hereinafter, “Wholesale Orders”) are governed by the following exclusive commercial conditions, which shall prevail over retail sales terms:

  • Minimum Order Quantity and Volume (MOQ): To qualify for distributor pricing, the Client must meet a minimum order of 50 kilograms per transaction or a minimum invoice value equivalent to $1,000 USD (or its equivalent in MXN/CAD).
  • Quotation Process and Purchase Orders: Wholesale prices are not displayed on the public platform. Distributors must request a formal quote through the site’s B2B tools. Issued quotes are strictly valid for 15 calendar days due to green coffee international price fluctuations on the New York Stock Exchange.
  • Payment Terms and Methods:
    • All wholesale orders require a 100% advance payment upon order confirmation.
    • Wholesale payments will be accepted exclusively via international bank wire transfers (SWIFT/SPEI). Credit cards or digital wallets are not accepted for commercial volume purchases unless previously agreed upon in writing.
  • Logistics and Shipping Terms (Incoterms):
    • Shipments within Mexico: Deliveries are made under FOB (Free on Board) terms at the Seller’s warehouse or through the freight carrier chosen and paid for by the Distributor.
    • International Shipments (U.S. and Canada): Unless otherwise agreed, shipments will be quoted under the DAP (Delivered at Place) Incoterm, where the Seller delivers the goods to the agreed destination, but the Distributor is solely responsible and obligated to pay import taxes, customs duties, and hire a local customs broker if their cargo volume exceeds courier express limits (de minimis).
  • Order Lead Times: Since the coffee is freshly roasted to guarantee batch quality, wholesale orders require a processing and roasting time of 5 to 10 business days prior to shipping, depending on the volume requested.
  • Brand and Packaging Usage (White Label / Third-Party Coffee):
    • If the Distributor purchases the product under the Seller’s brand, they agree to respect the graphic identity and shall not alter, repackage, or relabel the coffee.
    • In the case of toll manufacturing or White Label services, design, packaging, and intellectual property rights conditions shall be regulated under an independent manufacturing agreement.
  • Bulk Warranty and Claims: The Distributor has a maximum period of 2 business days following receipt of the cargo to report shortages, physical damage to transport packaging, or cup profile non-conformities. After this period, it will be understood that the merchandise was received to their total satisfaction.
